Where investors for suitable locations have been found or if investors are interested in an area as a site for a large space retail trade project, it must be established depending on the location, whether the project is compatible enough to integrate into the existing retail trade landscape.
This means that it must be assessed and evaluated to what extent the realisation of the project will trigger significant effects relating to regional planning and urban development policy with respect to Sec. 11 para. 3 of the German Federal Land Utilisation Ordinance (BauNVO) (in connection with the respective state regulations and ordinances) or to Sec. 34 Town and Country Planning Code (BauGB).
